Terms of Service

By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines, which are incorporated into these Terms by reference. If you are using the Service on behalf of a church or other organization, you represent that you have authority to bind that organization to these Terms, and "you" includes that organization.

If you do not agree to these Terms, do not use the Service.

Psalmly is offered to churches located in the United States, and the Service is intended for use in the United States. We are not able to set up a church outside the United States today, and we may decline or close a church that is not U.S.-based. We may add other countries in the future, but nothing here is a commitment to do so.

The Service is not directed to the European Economic Area, the United Kingdom, or Switzerland, and we do not offer it to churches or users located there. If you choose to access the Service from outside the United States, you do so on your own initiative and are responsible for complying with the laws that apply to you where you are.

Online giving carries a further requirement. Because the church is the recipient and merchant of record for every gift, it must be able to complete Stripe's U.S. verification and hold a U.S. bank account in order to receive donations (see Online giving). Subscription prices, donations, and every amount shown in the Service are in U.S. dollars.

To use most features you must create an account. You agree to provide accurate information, keep it up to date, and keep your sign-in credentials confidential. You are responsible for all activity under your account. Tell us promptly at support@psalmly.app if you suspect unauthorized use.

You must be at least 13 years old to hold an account, and if you are a minor in your jurisdiction you must have the consent of a parent or guardian. Anyone who administers a church must be an adult (18 or older). We may suspend or remove an account that we learn does not meet these requirements.

Psalmly is multi-tenant: a person can belong to many churches, as a member or an admin, and can create a new church and become its admin. Each church controls its own data, members, content, and settings.

If you administer a church, you are responsible for using the Service lawfully; for the accuracy of what your church publishes and sends; for managing your members and the roles you assign; for obtaining any consents needed to add or record information about other people (including minors, and including people who do not use Psalmly); for telling people when they are being recorded and obtaining any consent that recording requires where you are; and for how your church uses the giving, directory, communication, and AI tools.

If you are a member, you are responsible for the content you post and the accuracy of the information you provide.

You agree not to:

• use the Service for anything unlawful, fraudulent, harmful, or deceptive;
• post or transmit content that is harassing, hateful, defamatory, obscene, or that infringes others' rights;
• upload information about other people without the rights or consents needed to do so;
• send spam or unsolicited messages, or misuse the giving tools for money laundering or fraud;
• attempt to access accounts, data, or systems that are not yours, or circumvent security or usage limits;
• upload malware, scrape the Service, or interfere with its operation;
• misuse the AI features, impersonate others, or misrepresent your affiliation.

Our Community Guidelines describe what we expect of content posted in the Service, and apply alongside this section.

Enforcement. We may remove content, restrict a feature, suspend an account, or suspend an entire church that we reasonably believe violates these Terms or the Community Guidelines, or that presents a risk to other users, to us, or to the public. Where a church is suspended, its public pages are taken down and it cannot receive new gifts; recurring gifts already set up must be cancelled through the church's own Stripe account. We will generally tell you why, and you may respond by writing to support@psalmly.app, though we are not obliged to restore access.

Psalmly's core church-management features are free. Paid plans (currently Community and Growth) add AI features, the church's books (recording cash and check offerings, expenses, fund opening balances and pledges), a custom domain, no Psalmly platform fee on donations, and higher limits. A church's subscription is purchased and billed through Stripe on a monthly or annual basis and renews automatically until cancelled.

Member limits. Each plan includes a number of people: everyone who has joined the church on Psalmly, its admins included, and everyone the church keeps on its roster. We will never block anyone from joining a church. When a church has more people than its plan includes, we tell its admins, and two weeks later its new announcements and bulletins can't go out until it moves to a plan that fits or is back within its limit. Everything else keeps working, and no one is removed.

You can change or cancel your plan anytime from your church's billing page; cancellation takes effect at the end of the current billing period, and access continues until then. Fees are exclusive of any taxes, which you are responsible for. Except where required by law, payments are non-refundable.

AI credits. Paid plans include a monthly allowance of AI credits that resets each month and does not roll over. A church on a paid plan may also buy additional credits as a one-time purchase. Purchased credits do not expire and remain available while the church's account is open, but they are non-refundable, have no cash value, and cannot be transferred between churches. If a payment for credits is refunded or disputed, we may remove the corresponding credits from the church's balance.

Downgrading. If a church moves to the free plan, or its subscription lapses, the paid features stop: AI features are switched off, new offerings, expenses, opening balances and pledges can no longer be recorded (everything already recorded stays available to view and export), any connected custom domain is disconnected from Psalmly, and the Psalmly platform fee begins to apply to donations (see Online giving). The church's data is not deleted. If the church then has more people than the free plan includes, the member limits above apply. If a renewal payment fails, the church keeps its plan for up to 14 days while the payment is retried; if it still has not gone through by then, the subscription lapses.

We may change our prices; we will give reasonable notice before a change affects you, and the price shown at checkout always governs.

The Service lets churches accept online donations through Stripe. The church, not Psalmly, is the recipient and merchant of record for every gift; Psalmly is not a party to the donation, is not a charity, money transmitter, or payment processor, and never holds the funds. Donations are handled by Stripe, and your use of giving is also subject to Stripe's terms. Giving is available only to churches that meet the U.S. requirements described in Where Psalmly is available.

Fees. Standard Stripe card- and bank-processing fees always apply and are set by Stripe. In addition, Psalmly charges a platform fee on donations to churches on the free plan — currently 2% of the gift — and no platform fee to churches on a paid plan. We will give reasonable notice before changing that rate.

Covering fees. A giver may optionally add an amount so that the church receives the full gift they intended. Where offered, that amount covers both the payment-processing fee and, on a free-plan church, the Psalmly platform fee — so a portion of it is paid to Psalmly. Choosing not to cover fees does not reduce the gift; the fees are simply deducted from it instead.

Recurring gifts. A recurring gift continues until the giver cancels it, the church stops it, or a campaign it is attached to ends. If a church's plan changes so that the platform fee starts or stops applying, the amount charged for an existing recurring gift may change accordingly, so that the church keeps receiving the intended amount. Givers can view, change, or cancel a recurring gift at any time from their giving page.

Refunds, disputes, and chargebacks for a donation are handled by the church through its own Stripe account. Psalmly provides receipts and year-end contribution statements as a convenience, but the church is responsible for the accuracy of its giving records and any tax acknowledgments. Psalmly does not provide tax, accounting, or legal advice — please consult a professional for those.

Churches on a paid plan can enable AI features — an assistant that answers questions about the church, and tools that help leaders draft text, generate forms and pages, create artwork, produce notes from a recording, and read scanned documents. They are provided on an "as is" basis as an aid, not a source of professional advice. Responses may be inaccurate or incomplete and should not be relied upon for legal, financial, medical, or spiritual decisions.

A person always reviews and confirms before an AI feature saves, sends, or publishes anything. We use third-party AI providers to deliver these features, as described in our Privacy Policy, and we apply usage limits measured in AI credits. You are responsible for what you submit to an AI feature and for reviewing what it produces before you use it.

Subject to your compliance with these Terms, we do not claim ownership of the output an AI feature generates for you. Because these systems are probabilistic, similar output may be generated for other users, and we cannot promise that output is unique or that it can be protected by copyright.

You and your church retain ownership of the content you submit to the Service. You grant Psalmly a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify and create derivative works of (for formatting, resizing, indexing, and similar technical purposes), publicly display, publicly perform, distribute, and transmit that content as needed to operate and provide the Service.

Some specifics, so this is not a surprise: if your church publishes content to its public website, that content is displayed publicly on the open internet and may be indexed by search engines; content is processed by the providers listed in our Privacy Policy in order to store, deliver, and email it; and where a church has enabled AI features, its published content may be indexed into a searchable form so the assistant can answer questions about it. This license exists only to run the Service, and it ends when you delete the content, except for copies already distributed (such as an email already sent) and copies retained as described in the Privacy Policy.

You represent that you have the rights necessary to submit your content and to grant this license, and that your content does not violate these Terms or the law. You are responsible for keeping your own copies, and we may remove content that violates these Terms.

Feedback. If you send us suggestions or ideas about the Service, we may use them without restriction or obligation to you.

The Service — including its software, design, and the Psalmly name and logo — is owned by Psalmly and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service as permitted by these Terms. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Service except as the law allows. Third-party components included in the Service remain subject to their own licenses.

We respect intellectual-property rights and expect our users to do the same. If you believe content on the Service or on a church's public website infringes your copyright, email support@psalmly.app with: your contact details; identification of the work you say is infringed; the URL or location of the material you want removed; a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act on the owner's behalf; and your physical or electronic signature.

We will review and, where appropriate, remove or disable access to the material, and notify the church that posted it. If you believe your content was removed in error, you may reply with an explanation and we will consider it. We may suspend or terminate the accounts of users or churches who repeatedly infringe.

The Service relies on third parties — including Stripe, Supabase, Vercel, and the providers listed in our Privacy Policy. Your use of features they power may be subject to their terms, and we are not responsible for third-party services we do not control, including their outages, changes, or discontinuation.

Churches on a paid plan can connect a domain name they own to their Psalmly website. You are responsible for registering and renewing that domain, for keeping its DNS records pointed at us, and for your registrar relationship — we never own or register a domain on your behalf. We provision and renew the TLS certificate for it while it is connected.

If the church's paid plan ends, is cancelled, or lapses, the custom domain is automatically disconnected from Psalmly and the site stops being served at that address; the church's Psalmly-hosted address continues to work. We may also disconnect a domain if it is used in breach of these Terms or if a technical or security problem requires it.

You may stop using the Service at any time. You may leave a church, and you may delete your account, with one condition: if you are the only lead admin of a church that is still open, you must first hand that role to someone else or close the church — otherwise the church would be left with no one able to administer it.

Account deletion is scheduled, not immediate: your account enters a 30-day waiting period during which you can sign back in and restore it, after which it is permanently deleted. Recurring gifts continue to be charged during that period unless you cancel them, and giving records are retained as described in our Privacy Policy.

Closing a church. A lead admin can close a church. Closing takes its public pages down and ends its subscription, but its giving ledger is retained so that its members keep access to their contribution statements and the church keeps a record of what it received. Closing is not a self-serve undo — contact us if you need a closed church reopened.

We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. When access ends, the rights granted to you under these Terms stop, though the provisions listed in General terms survive.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your requirements. We do not guarantee any level of uptime and do not offer a service-level agreement.

To the fullest extent permitted by law, Psalmly and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid Psalmly in the twelve months before the claim or one hundred U.S. dollars.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless Psalmly from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or — if you administer a church — your church's use of the Service and handling of its members' information.

If you download our mobile app from the Apple App Store or Google Play, you also agree to that store's terms, and the following applies to the extent it conflicts with anything else here.

Apple. These Terms are between you and Psalmly only, not Apple, and Psalmly — not Apple — is solely responsible for the app and its content. Apple has no obligation to provide any maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Psalmly, not Apple, is responsible for addressing any claim relating to the app, including product-liability claims, any claim that the app fails to conform to a legal requirement, and claims under consumer-protection or similar law. Psalmly, not Apple, is responsible for investigating and resolving any third-party claim that the app infringes intellectual-property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google. Where you obtain the app from Google Play, Google is not a party to these Terms and is not responsible for the app.

We are always improving Psalmly, so we may add, change, or discontinue features. We may also update these Terms; when we make material changes, we will update the "Last updated" date and provide reasonable notice, such as an email or an in-app notice, before they take effect. Your continued use of the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of New Mexico and applicable U.S. federal law, without regard to conflict-of-laws principles. If you have a concern, please contact us first at support@psalmly.app — we will try to resolve it informally. Any dispute that cannot be resolved that way will be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico, and you consent to venue there.

Class-action and jury waiver. To the fullest extent permitted by law, you and Psalmly each agree to bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative action, and each waive any right to a trial by jury. If this paragraph is found unenforceable as to a particular claim, it remains in effect for all others.

You must bring any claim relating to the Service within one year after it arises, or it is permanently barred, except where applicable law does not allow that limit.

• Survival. Sections that by their nature should survive do so, including Your content (for copies already distributed), Our intellectual property, Disclaimers, Limitation of liability, Indemnification, Governing law and disputes, and this section.
• Severability. If any provision is held unenforceable, it is modified to the minimum extent necessary, and the rest remains in effect.
• Entire agreement. These Terms, the Privacy Policy, and the Community Guidelines are the entire agreement between you and Psalmly about the Service, and replace any earlier agreement about it.
• No waiver. If we do not enforce a provision, that is not a waiver of our right to do so later.
• Assignment. You may not assign or transfer these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
• Force majeure. Neither party is liable for a delay or failure caused by something beyond its reasonable control, including outages of the third-party services the Service depends on.
• Notices. We may send you notices by email to the address on your account, or through the Service. Send notices to us at support@psalmly.app.
• Electronic communications. You consent to receive agreements, notices, receipts, and year-end contribution statements from us electronically, and agree that electronic delivery satisfies any legal requirement that such communications be in writing.
• Export. You agree to comply with U.S. export-control and sanctions laws in your use of the Service.
• Relationship. These Terms do not create a partnership, joint venture, employment, or agency relationship between you and Psalmly.
