Terms of Service

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of a church or other organization, you represent that you have authority to bind that organization to these Terms, and "you" includes that organization.

If you do not agree to these Terms, do not use the Service.

To use most features you must create an account. You agree to provide accurate information, keep it up to date, and keep your sign-in credentials confidential. You are responsible for all activity under your account. Tell us promptly at support@psalmly.app if you suspect unauthorized use.

You must be at least 13 years old to hold an account, and if you are a minor in your jurisdiction you must have the consent of a parent or guardian. Anyone who administers a church must be an adult (18 or older).

Psalmly is multi-tenant: a person can belong to many churches, as a member or an admin, and can create a new church and become its admin. Each church controls its own data, members, content, and settings.

If you administer a church, you are responsible for using the Service lawfully; for the accuracy of what your church publishes and sends; for managing your members and the roles you assign; for obtaining any consents needed to add members' information (including information about minors); and for how your church uses the giving, directory, and communication tools.

If you are a member, you are responsible for the content you post and the accuracy of the information you provide.

You agree not to:

• use the Service for anything unlawful, fraudulent, harmful, or deceptive;
• post or transmit content that is harassing, hateful, defamatory, obscene, or that infringes others' rights;
• upload information about other people without the rights or consents needed to do so;
• send spam or unsolicited messages, or misuse the giving tools for money laundering or fraud;
• attempt to access accounts, data, or systems that are not yours, or circumvent security or usage limits;
• upload malware, scrape the Service, or interfere with its operation;
• misuse the AI assistant, impersonate others, or misrepresent your affiliation.

We may remove content or suspend access that we reasonably believe violates these Terms.

Psalmly's core church-management features are free. Paid plans (currently Community and Growth) add the AI assistant and higher limits. A church's subscription is purchased and billed through Stripe on a monthly or annual basis and renews automatically until cancelled.

Member limits on each plan are soft — we will never block a member from joining, and we may prompt you to upgrade as your church grows. You can change or cancel your plan anytime from your church's billing page; cancellation takes effect at the end of the current billing period, and access continues until then. Fees are exclusive of any taxes, which you are responsible for. Except where required by law, payments are non-refundable.

We may change our prices; we will give reasonable notice before a change affects you, and the price shown at checkout always governs.

The Service lets churches accept online donations through Stripe. The church, not Psalmly, is the recipient and merchant of record for every gift; Psalmly is not a party to the donation, is not a charity, money transmitter, or payment processor, and never holds the funds. Donations are handled by Stripe, and your use of giving is also subject to Stripe's terms.

Standard Stripe card-processing fees always apply. Psalmly charges a platform fee on donations to churches on the free plan, and no platform fee to churches on a paid plan. Donors may optionally cover fees so the church receives the full intended gift.

Refunds, disputes, and chargebacks for a donation are handled by the church through its own Stripe account. Psalmly provides receipts and year-end contribution statements as a convenience, but the church is responsible for the accuracy of its giving records and any tax acknowledgments. Psalmly does not provide tax, accounting, or legal advice — please consult a professional for those.

When a church enables the AI assistant, it is provided on an "as is" basis as an aid, not a source of professional advice. Its responses may be inaccurate or incomplete and should not be relied upon for legal, financial, medical, or spiritual decisions. The assistant only proposes actions for a person to confirm. We may use third-party AI providers to deliver this feature and may apply usage limits.

You and your church retain ownership of the content you submit to the Service. You grant Psalmly a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), display, and transmit that content as needed to operate and provide the Service — for example, to show a group photo to that group or deliver an announcement by email.

You represent that you have the rights necessary to submit your content and to grant this license, and that your content does not violate these Terms or the law. You are responsible for keeping your own copies, and we may remove content that violates these Terms.

The Service — including its software, design, and the Psalmly name and logo — is owned by Psalmly and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service as permitted by these Terms. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Service except as the law allows.

The Service relies on third parties such as Stripe, Supabase, and others. Your use of features they power may be subject to their terms, and we are not responsible for third-party services we do not control.

You may stop using the Service, leave a church, or delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. When access ends, the rights granted to you under these Terms stop, though provisions that by their nature should survive — such as the content licenses needed to operate, disclaimers, and limitations of liability — will continue. Giving and financial records are retained as described in our Privacy Policy.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your requirements.

To the fullest extent permitted by law, Psalmly and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid Psalmly in the twelve months before the claim or one hundred U.S. dollars.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless Psalmly from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or — if you administer a church — your church's use of the Service and handling of its members' information.

We are always improving Psalmly, so we may add, change, or discontinue features. We may also update these Terms; when we make material changes, we will update the "Last updated" date and provide reasonable notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of New Mexico and applicable U.S. federal law, without regard to conflict-of-laws principles. If you have a concern, please contact us first at support@psalmly.app — we will try to resolve it informally. Any dispute that cannot be resolved that way will be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico, and you consent to venue there.
