Terms of Service

These Terms of Service ("Terms") govern your access to and use of Psalmly, a service operated by Everwood Ventures, LLC ("Service", "we", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Accounts

You are responsible for the activity that occurs on your account and for keeping your password secure. You must notify us promptly of any unauthorized use. We are not liable for losses caused by unauthorized use of your account.

You must be at least 13 years old to use the Service. Accounts registered on behalf of an organization (e.g. a church or ministry) bind that organization to these Terms.

2. Acceptable use

You agree not to misuse the Service. This includes, but is not limited to:

  • Uploading content that is unlawful, infringing, or harmful.
  • Attempting to gain unauthorized access to other accounts or the Service's underlying systems.
  • Using the Service to send spam, phishing messages, or other abusive communications.
  • Reselling, sublicensing, or otherwise commercially exploiting the Service without our written permission.

3. Content ownership

You retain ownership of content you upload to the Service (e.g. congregation data, sermon notes, page content). By uploading it, you grant us a limited license to store, process, and display that content as needed to operate the Service.

4. Payments

Paid plans are billed in advance on a recurring basis until canceled. Fees are non-refundable except where required by law. We may change prices with at least 30 days' notice before the change takes effect for your account.

5. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate accounts that violate these Terms or applicable law. On termination, you may export your data for up to 30 days; after that, we may permanently delete it.

6. Disclaimers

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to the Service will not exceed the greater of (a) the fees you paid us in the 12 months before the claim or (b) US $100.

8. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and update the "Last updated" date above. Continued use of the Service after changes constitutes acceptance.
